Custodian of Evacuee Property

The office of the Custodian was established to administer and manage the properties left behind by Portuguese Nationals in Goa, Daman and Diu.

The office of Custodian of Evacuee Property came into existence in the year 1962. The Evacuee Property Act and Rules were published in The year 1964 &1965 and actual charge of the properties taken over in the year 1968/69.

The Goa , Daman & Diu Administration of Evacuee Property Act, 1964(No .6 of 1964) passed by Legislative Assembly of Goa Daman & Diu, received assent of the President of India on 24 th December 1964 and it came into force at once. Although the Administration of Evacuee Property Act, 1964 and Rules, 1965, were published the actual charge of properties taken over in the year 1968/69.

Actual charge was taken over in the year 1968/69 by the Custodian. It is therefore assumed that the construction which were existing upto 1967 are legal and those which came thereafter are illegal.

 

In the year 1967 there were 340 legal houses at Mayem. No permissions have been given to construct new houses in the Evacuee property at Mayem after 1967 till date.

 

However, thereafter from the year 1968 to 30-6- 2000 about 397 illegal houses have been constructed. Vide Notification dated 4/6/2001 the Govt. has carried out an Amendment to Evacuee Properties Act 42 of 2001 by which every person who is in occupation as on 30/6/2000 of any dwelling house situated in Evacuee Property shall be deemed to be a Mundkar of his dwelling house.

 

Further, from July 2000 till date additional 158 illegal houses have come up thus total comes to 340+397+158= 895. It is observed that large number of illegal constructions are going on in the Evacuee Property at Mayem. In addition to legal and illegal houses there exist many other structures in the Evacuee property at Mayem huts, sheds, Toilets, Poultry, Cow Sheds Godown, Temple, Shops, Storeroom, Mills, Pump houses, School, Churches, Garages, Cross, Bars, Math, Saloons, Hotels, Carpentry, Club, Library, Workshop, Photo studios etc as detailed below:

The Govt. made applicable the Mundkar Act and also Agriculture Tenancy Act to the people residing in the evacuee properties. As per amendment carried out to Goa Act 3 of 1995 applied the provision of the Goa, Daman and Diu Mundkars (Protection from eviction Act 1975) (Act 1 of 1976) to evacuee Administration of Evacuee Property Act 1964 (Act 6 of 1964) and Goa Act 42 of 2001 further amend the Goa, Daman, and Diu Admn. of Evacuee Property Act 1964 (Act No 6 of 1964) which provides every person who is in occupation as on 30 th day of June 2000, of any dwelling house situated on the evacuee property vested in the Custodian to be a Mundkar of his dwelling house and further that every person evicted from such dwelling house on and from the date of coming into force of the said Act and upto 30 th day of June 2000 shall be entitled to restoration of his dwelling house, if he makes an application to the Mamlatdar within one year from the date of coming into force of the said Act provided that the Mamlatdar shal dispose of the application so filed within 3 months of such filing.

 

Besides, the Goa Administration of Evacuee Property (Amendment Act 1989 ( Goa Act No 19 of 1989) the Govt. made applicable tenancy right on the tenants of Agriculture lands which are evacuee properties and to amend the Goa, Daman and Diu Administration of Evacuee Property Act 1964 and the Goa, Daman and Diu Agriculture Tenancy Act 1964 shall apply in respect of Agriculture land tenancies created by the Custodian.

 

In the Evacuee Property at Mayem there are 895 houses. However, it is pertinent to know from the Mamlatdar of Bicholim that there are only 15 persons registered as Mundkars and 9 cases are in progress/pending from the above it can be seen that the people residing in Evacuee Property Mayem are not coming forward to avail the facilities extended to them by the Govt. for the reasons best known to them.

 

As per the records, this office has considered request of various authorities and permissions/no objection certificates have been granted for various developmental works at Mayem such as for illumination of roads, release of water and electricity connection to genuine Mundarial houses, widening and asphalting of roads, construction of retaining walls beatification at Ganpati Visarjan spots, drainages, bus stop shades, construction of rooms for ladies and gents near Dhond Tholi constructon of stages near Govt. Primary School, a temples, desilting of Nallas, repair of foot bridges, culvets, bandhs, spring sidewalls, Bandaras etc.

Besides Evacuee Property land is acquired by the Govt. for construction of Govt. Polytechnic for the benefit of Engineering students of Bicholim and neighbouring talukas construction of Tourism cottages and beautification of Mayem lake etc land is also given on lease to construct Panchayat Ghar at Mayem.
